Folks, I have just been sent the following link. In a case involving council tax nonpayment, a businessman has challenged the authority of the magistrates who did not take their oath of office. Magistrates then left court, man declares self sovereign, and dismisses case. Bailiffs sent round anyway, man tells bailiffs to leave -and they do.

Bailiffs rarely fight you though, When they evicted my friend's neighbour (a single mum nurse) and I helped her move I told them to beat it quickly or suffer the consequences - with them not knowing my name I was ready for a struggle if it came down to it, but they left.

Presumably they came back with the police but we'd moved her by then, and her two children. They were demanding her keys, if I hadn't of become assertive I think they would of tried to seize her furniture for the councils rent (?). Anyway, over my dead body, but follow this case as it's not over yet.

And surely this shouldn't be dealt with in a magistrates court? Why is it that for council tax and council rent you end up in a magistrates court (criminal court) for non payment when if for example you don't pay your water bill you end up in civil (county) court...?

This cannot be right, what is going on with this.

I know this for a fact because I was in civil court (and won) for refusing to pay united utilities (long story - I still don't pay, I'm waiting to do a counter claim next time they summons me). So why is it that you end up in criminal court for not paying the council..?
As far as I can work out they use the Magistrates court to issue the fake liability order used to scare us into paying.
When I wrote to the court declining their services the magistrates had no record of the case number quoted.
When I turned up at court I was told that I wouldn't be allowed to appear at the hearing !!!!!
They proceeded in my absence even though I was there !
Now I have been getting visits from the bailiffs but they havn't called when i've been home yet.

Its not much of a plan but the best I have come up with so far ! I have drawn my line in the sand and will stand by my principles where ever that takes me.
The biggest question we need to ask is this..is it against the law to be in Debt?...No..why am I being tried in a magistrates court? non payment of council tax and rent are civil offences and must be dealt with in county court under common law, so the person or (corporation) can gain lawful remedy..by way of making a lawful and binding payment plan that can be afforded by the debtor.. If there is no trust in the arbitrator(court official) be it a Judge or a magistrate then NO lawful remedy can be sought and no penalties awarded, if it can be proved that the person suffered any Loss because of the debtors actions, it then falls into the relams of criminal damages against the sovereign at the hands or actions of the debtor, but a corporation can only use staute law to defend its self (unless it can be proven that items or products have been stolen from them) as it is a fictional entity and cannot suffer loss in a lawful sense.!
